1. DEFINITIONS
   • Applicable Law means any national or provincial legislation, statutes, ordinances and other laws and regulations and any by-laws of any legally constituted public authority, in each case in force at any time in any relevant jurisdiction;
   • Competition means the “Drive with Sundowns Car Giveaway Competition”;
   • Competition Period means the period contemplated by clause 3 below;
   • Participant; means a natural person who enters the Competition in accordance with the Terms and Conditions;
   • Terms and Conditions means these terms and condition, which set out the rules and terms and conditions for the Competition;
   • Mamelodi Sundowns means Mamelodi Sundowns Football Club Proprietary Limited, a private company registered in accordance with the laws of the Republic of South Africa under registration number 1996/004556/07.
2. ACCEPTANCE OF TERMS
   • These Terms and Conditions regulate a Participant’s participation in the Competition and set out the terms and conditions, which apply in respect to the Competition.
   • Please read these Terms and Conditions carefully before participating in the Competition. By participating in the Competition you accept or agree to these Terms and Conditions and agree to be bound and abide by these Terms and Conditions.
   • Mamelodi Sundowns recommends that Participants print a copy of these Terms and Conditions for future reference.
   • Mamelodi Sundowns may revise and update all or any part of these Terms and Conditions at any time by amending the relevant pages. All changes are effective immediately when Mamelodi Sundowns publishes them on its website and apply in respect to the Competition thereafter.
   • Participants are expected to check these Terms and Conditions from time to time in order to take notice of any changes they may be made. It is a Participant’s responsibility to check the Terms and Conditions on a regular basis to ensure that they are aware of the terms of the Competition as updated from time to time.
   • These Terms and Conditions must be read together with all other applicable Mamelodi Sundowns’ policies, which may be found at https://sundownsfc.co.za/
   • To the extent permitted by Applicable Law, Mamelodi Sundowns will not be liable for any liability arising under or in connection with these Terms and Conditions and the Competition including (without limitation) liability in contract, delict, tort, misrepresentation, breach of statutory duty or otherwise for any loss or damage, even if foreseeable. Without limiting the foregoing, this includes (without limitation) participation or inability to participate in the Competition.
   • To the extent permitted by Applicable Law, Participants hereby indemnify Mamelodi Sundowns and hold it harmless from and against any and all, claims, losses, liabilities damages, costs or expenses (including (without limitation) reasonable attorneys’ fees) arising out of the participation in the Competition.
   • To the extent that the Terms and Conditions or any goods or services provided under the Terms and Conditions are governed by the Consumer Protection Act, 2008 (“the CPA”), no provision of these Terms and Conditions is intended to contravene the applicable provisions of the CPA. Therefore, all provisions of the Terms and Conditions must be treated as being qualified, to the extent necessary, to ensure that the applicable provisions of the CPA are complied with.
3. Competition Period
   • Competition period is from 13 May 2025 to 18 May 2025, 16h30. (“the Competition Period”). The closing date and time 16h30, 18 May 2025.
   • Promotion period is from 13 May 2025 to 18 May 2025. (“the Promotional period“).
   • Mamelodi Sundowns may, at its sole and absolute discretion, amend or withdraw the competition. Participants agree that in such an event, they shall have no right of expectations or claim against Mamelodi Sundowns.
4. Who May Enter?
   • To be eligible to participate in the Competition, Participants must be:
     • members of the Mamelodi Sundowns Membership Club;
     • 18 years or older;
     • a South African Citizen; and
     • the holder of a valid South African Identity Document.
   • Participation in the Competition excludes employees, directors, partners, consultants, and agents of, or any other person who, directly or indirectly controls or is controlled by Mamelodi Sundowns or marketing service providers of the Competition (and the spouses, life partners, immediate family members or business partners of the people or entities listed above).
   • Supplier/s of goods and or services of the Competition and promotional partners, printers, advertising and promotional agencies, professional advisors and point of sale staff employed by or contracted to, or providing goods or services of any kind, to all the people or entities listed in clauses 2 and this 4.3 during the Competition Period shall be ineligible to participate in the Competition.
5. How to PARTICIPATE
   • During the Competition Period, the Participants that meet all the criteria referred to in clause 4 above as well as fulfilling the below criteria stand a chance to win a prize contemplated in clause 7
   • To enter the competition Participants must:
     • during the Competition Period purchase an adult match day ticket for the Mamelodi Sundowns FC v Magesi FC Betway Premiership football match scheduled for 18 May 2025;
     • on arrival at the stadium on 18 May 2025, Participants must access the stadium at gate 1,2,3, 4, 6 or 11 and drop their ticket stubs in the secure yellow competition box located at the aforementioned gates; and
     • participants must ensure that their first name, surname, their Mamelodi Sundowns Membership Club number and contact details (telephone number) are recorded on their ticket stubs, which they drop off at the gates mentioned in clause 2.2 above.

6. How the Competition works?
   • Once the Competition Period lapses and at 16h30, all the ticket stubs will be collected and a random draw will be conducted live at 17h15 on the field. Eight random names will be drawn and one of the eight will, subject to eligibility requirements win a car. The remaining seven participants with subject to eligibility requirements win the remaining prizes in clause 7.
7. The Prize
   • The Prizes to be won include:
     • 1^st prize: one vehicle to be announced at the stadium
     • 2^nd prize: Huawei Nova i13 or equivalent;
     • 3rd prize: framed and signed 24/25 Mamelodi Sundowns replica t-shirt;
     • 4^th prize: Puma Merchandise voucher;
     • 5^th prize: Biogen Hamper or equivalent;
     • 6^th prize: Red Bull Hamper or equivalent;
     • 7^th prize: Southern Sun 2-night accommodation for 2 (only breakfast); and
     • 8^th prize: Two (2) CAF final first leg VIP tickets at Loftus Stadium scheduled for 24 May 2025.
   • The prizes listed in this clause 7 make up the prizes that may be won by Participants and no Participant shall have an expectation to win any other prize in terms of the Competition. No other prizes may be won by Participants and no prize may be exchanged for cash or otherwise.
   • Mamelodi Sundowns shall not be liable or responsible for any costs, expenses or liability associated with a Participant claiming their prize and/or any action taken by a Participant following winning their prize or enforcing their rights in terms of these Terms and Conditions.
   • The winner of the car shall not be permitted to sell or transfer the car without the prior written consent of Mamelodi Sundowns and on the terms and conditions to be determined by Mamelodi Sundowns at its sole discretion.
8. General
   • Mamelodi Sundowns its respective directors, affiliates, members, partners, employees, agents, consultants, suppliers, contractors, subsidiaries and sponsors assume no liability whatsoever for any direct or indirect loss or damage, including but not limited to physical harm or death, howsoever arising from or as a result of an entrant’s participation in the Competition or the entrant’s redemption of any prize in terms of this Competition, or from any amendments to the prize details and/or the terms and conditions of this Competition. All entrants (including the winner) hereby expressly indemnify the Mamelodi Sundowns in this regard and shall hold it harmless from all and any claims arising from or as a result of the above reasons.
   • To the extent that Mamelodi Sundowns’ liability cannot be excluded in law pursuant to these Terms and Conditions, Mamelodi Sundowns’ entire liability under these Terms and Conditions will be limited to the value of the equivalent number of prizes. By participating in the competition and to the extent permitted by applicable law, you waive any and all rights to bring any claim or action related to any breach of these Terms and Conditions beyond 1 month after the date on which the cause of action giving rise to the claim arose.
   • Mamelodi Sundowns will not be liable for any indirect or consequential losses, loss of profit, loss of contract or loss of reputation arising from your entry into or participation in this Competition.
   • Any amended terms and conditions published in any media, or on the Mamelodi Sundowns website www.sundownsfc.com, will form part of the terms and conditions of the Competition, to which terms the entrants agree to be bound.
   • Winners shall be contacted on the cell phone number/via the medium used to enter the Competition or in terms of any contact details supplied by the winner when entering the Competition. Mamelodi Sundowns shall attempt to contact the winner three consecutive times, via telephonic call during the live draw after his or her name is drawn as a possible winner. In the event that the winner is either uncontactable (during the time frames stipulated above) or in the event that the winner rejects, or declines acceptance of the prize, the prize shall be subject to a new draw.
   • Further, should contact have been made by Mamelodi Sundowns with the winner after they have won a prize, and the winner is thereafter uncontactable for the purposes of delivery of the prize, Mamelodi Sundowns shall attempt to contact the winner for a period of time stipulated in clause 8.5 and if the winner is uncontactable, the prize will be forfeited.
   • The decision of Mamelodi Sundowns in respect of disputes arising out of this Competition shall be dealt with by Mamelodi Sundowns in terms of these terms and conditions. The decision of Mamelodi Sundowns in this regard shall be final.
   • Winners are only entitled to win 1 (one) Prize each.
   • Mamelodi Sundowns reserves the right to withhold a prize until it is entirely satisfied that the claimant of the prize is the bona fide winner and reserves the right to call for such proof as it may deem necessary.
   • Winner’s consent in writing to their name, image and likeness being used and published by the Mamelodi Sundowns in connection with this Competition for a period of 12 (twelve) months after they are announced as winners. Winners may decline the use of their name, likeness and image by the Mamelodi Sundowns.
   • By entering this Competition entrants signify their consent to be bound by the terms and conditions contained herein.
   • Winners agree that it is an express condition of the Competition that in order to be eligible to redeem a prize, the winner shall be required to sign the appropriate acknowledgement of receipt of the prize, as well as an indemnity and/or waiver of liability as reflected in these terms.
   • We respect your privacy and by agreeing to this Terms and Conditions you voluntarily agree to abide by our privacy policy, which can be viewed at https://sundownsfc.co.za/
   • Mamelodi Sundowns collects and uses information (including personal information as defined in the Protection of Personal Information Act of 2013 (POPIA)) in order to enable your participation in the competition and to verify your eligibility, related activities, and for other reasons, such as to communicate with you, for gathering statistics or market information, or to compile a broad profile of supporters who engage with Mamelodi or its sponsors. By participating in the Competition you consent to the processing of your personal information.
   • For these purposes, Participants will be asked to provide their details including but not limited names, phone numbers, e-mail addresses, and ages.
   • Your personal information will be kept securely and in accordance with generally accepted security standards.
   • We do not authorise third parties to use or disclose your personal information, except as we request of them for the purpose of giving effect to these Terms and Conditions.
   • These rules are governed by the laws of South Africa. You consent to the non-exclusive jurisdiction of the non-exclusive jurisdiction of the High Court of South Africa, Gauteng Local Division, Johannesburg in any dispute arising from or in connection with these Terms and Conditions.
   • If any provision of the rules is found to be invalid or unenforceable by any court of competent jurisdiction, then that provision will be severed from the rules and shall not affect the validity or enforcement of any remaining provisions.
   • Except as expressly provided in these Terms and Conditions, the rights and remedies provided under these Terms and Conditions are in addition to, and not exclusive of, any rights or remedies provided by law.
   • Unless otherwise expressly provided, nothing in these Terms and Conditions is intended to, or shall be deemed to, establish any partnership or joint venture between any of the parties, constitute any party the agent of another party, or authorise any party to make or enter into any commitments for or on behalf of any other party. Each party confirms it is acting on its own behalf and not for the benefit of any other person.
   • You may not assign, cede, delegate or otherwise transfer or deal with these Terms and Conditions or any of your rights and obligations under them without the prior written consent of Mamelodi Sundowns. Mamelodi Sundowns may at any time assign, cede, delegate or otherwise transfer or deal any of its rights or obligations under these Terms and Conditions.
   • These Terms and Conditions contain the entire agreement and understanding between the parties and supersedes any prior written or oral agreement between them in relation to the matters dealt with in these Terms and Conditions. Save as expressly provided for in these Terms and Conditions, neither party shall have any claim or right arising from any undertaking, representation or warranty not included in these Terms and Conditions.
   • Any failure by any party to exercise or delay by any party in exercising its rights or remedies provided under these Terms and Conditions by law does not constitute a waiver of that or any other right or remedy and does not prevent, limit or restrict the future exercise or enforceability of that or any other rights or remedies. No single or partial exercise of any right or remedy provided under these Terms and Conditions or by law prevents or restricts the further exercise of that or any other right or remedy
   • If any provision of these Terms and Conditions which is not material to its efficacy as a whole, is rendered void, illegal or unenforceable in any respect under any law, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby and the parties shall endeavour in good faith to agree an alternative provision to the void, illegal or unenforceable provision.
   • These Terms and Conditions shall be binding and shall inure for the benefit of the successors and permitted personal representatives (as the case may be) of each of the parties.
   • These Terms and Conditions will be governed by and construed in accordance with the laws of South Africa.
   • Unless a contrary intention clearly appears: (i) headings are inserted in these Terms and Conditions for ease of reference only and do not form part of it for the purposes of interpretation; (ii) words importing: (a) any one gender includes the other two genders; (b) the singular includes the plural and vice versa: and (c) natural persons include created entities (corporate or unincorporated) and the state and vice versa; (iii) a reference to a document includes any variation or replacement of the document; and (iv) no provision of these Terms and Conditions will be construed adversely to a party solely on the grounds that the party was responsible for the preparation of these Terms and Conditions or that provision
   • Mamelodi Sundowns shall not be in breach of these Terms and Conditions nor be liable for delay in performing, or failure to perform, any of its obligations under these Terms and Conditions or any disruption to the Competition if such delay, failure or disruption results from any exceptional event or circumstance beyond its reasonable control, including without limitation, any of the following: Covid 19, act of God, governmental act, pandemic, war, fire, flood, explosion, industrial dispute (not being an industrial dispute involving the employees of the Promoter) or civil commotion (Force Majeure Event) despite having taken all reasonable steps to prevent such delay or failure. In such circumstances the Promoter shall be entitled to a reasonable extension of the time for performing such obligations. In the event of any disruption to the Competition Mamelodi Sundowns shall use its reasonable endeavours to remedy any disruption and resume the competition on a fair and equitable basis to the Contestants. If the period of delay or non-performance continues for 10 days, Mamelodi Sundowns may terminate these Terms and Conditions with immediate effect.
